土地のリース契約

外国人の土地購入については、課題が多いが、リースなら手軽に契約できる。外国人がフィリピンに住むなら、長期のリース契約を結んで家を建てるのがお奨めである。

通常の土地の長期リース契約でも、土地を購入することに比べれば、かなり割安で契約できるはずである。また、ダミーの名前を使って、外国人が土地を購入した場合にも、ダミーの人物を貸し手、購入した外国人を借り手としてリース契約書を作成することが多いが、この場合、金額の取り扱いは通常とは異なる。

今回は、以前建てたコテージに建築許可を申請するため、その必要書類の一つであるリース契約を、弁護士に依頼して作成してもらった。リースと言っても、土地の使用料は、もともと 払わない約束であった。このコテージは、私用というより、訪問者に無料で貸し出しているものだからである。そのことも契約書には記載してもらっている。通常のリース契約とは、異なるところだ。

期間は3年余りにしたが、それ以降は、弁護士は介さず、当事者でこの書類の余白を利用して、勝手に延長せよとのことであった。

契約書作成の費用として、書類作成の一律料金である500ペソを弁護士に支払った。赤字の部分を変えると、他にも文面を応用できる。


MEMORANDUM OF TERMS AND CONDTIONS
OF CONTACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:

LESSOR : LOLOTA P.TINGCANG, of legal age, married, with residence and postal address at Tongo, Siquijor, Siquijor, Philippines.

LESSEE : Taro Yamada, Japanese, of legal age, single, with residence and postal address at Pangi, Siquijor, Siquijor, Philippines.

SUBJECT OF LEASE: a five (5) meter by seven point two (7.2) meter portion of the following described parcel of land:

"A parcel of land situated in Tongo, Siquijor, Siquijor, Philippines; covered by Original Certificate of Title No. 5468 in the name of Serapio Ocso; known as Lot No. 63, Gss-1309; bounded on the North-East, along line 1-2, by the Mindanao Sea; on the South-East, along line 2-3, by Lot No.64, Gss-1309; and on the South-West, along line 3-4, by Lot No.65, Gss-1309; and on the North-west, along line 4-5, by Lot No.61, Gss-1309, and by Lot No.62 Gss-1309; containing an area of 3,297 square meters., more or less." of which the Lessor is the Administrator and an heir.

PURPOSE OF LEASE: Costruction and maintenance of a beach cottage.

TERM: from date to december 31, 2005.

RENT: Lessee shall not, and is not obliged , to pay rent.

CONDITIONS:

1.Lessee shall pay for the real estate taxes that may be assessed on the improvements (cottage) introduced by him.

2. Lessor is allowed to receive "tips", but not rentals, from patrons of the cottage/s.

3. Construction and maintenance of cottage/s at Lessee's expense.

Tingcang with her Community Tax Certificate No. CCI1999 19725054 issued on July 23, 2002 at Siquijor, Siquijor and Taro Yamada with his Community Tax Certificate No. CCI1999 19714039 issued on February 19, 2002 at Siquijor, Siquijor, both known to me to be the same persons who executed the foregoing Memorandum of Terms and Conditions of Lease Contract and they both acknowledged to me that the same is their free and voluntary act and deed.

This instrument consists of two (2) pages including the page upon which this acknowledgement is written and signed by the parties and their witnesses on both pages.
